The Jones Act’s liability standards are very favorable to injured seamen and are construed on behalf of those seamen.
To be more specific, The Jones Act applies to seamen who work on more than 50 types of vessels, among them freighters, tugs, tankers, jack-up rigs, barges, supply boats, semi-submersible rigs, dredges, fishing vessels, diving vessels, crew boats, and many other types of vessels. The Act requires employer payment for reasonable medical bills (“cure”), unearned wages when voyages are cut short by injury, and a modest daily allowance (“maintenance”) for injury-related time away from the job. In most circumstances when seamen suffer injuries or death, they may recover against their employers under the Jones Act and/or third parties under general maritime law.
